This is a Crime

“Kuwait University's faculty of Sharia, Prof Mohammed Al-Tabtebaei, recently issued a fatwa about how women should vote in the forthcoming parliamentary elections, reported Al-Watan.
In it, Al-Tabtebaei said husbands could direct their wives' voting choice by using their right of divorce, or the threat of divorce, if they vote for a candidate other than their choice. He said that even if a woman does so in secret she could still be legally divorced”
Kuwaittimes

Dr. Massuma Almobarak, the minister of Planning declared that this is against woman’s right to practice her freedom to choose who can represent her in the National Assembly. She added that she brought the subject to the attention of the Council of Ministers and she asked Justus minister to give an explanation of such fatwa according to AlGabas

Using religion in politics is the most serious and dangerous tool that some are manipulating as the day of the election is getting closer. Notice the excerpt “even if a woman does so in secret she could still be legally divorced” and imagine what pressure such women are going through, because the matter becomes an issue of 7aram wa 7alal for some women with true faith. Can you see how grave this is? And what implication it has on the structure of a family?
Sorry Dr. Massuma; but I think sterner actions should be taken against such Fatwas that only aim to keep women followers to their men. This is blackmailing of the first degree and I think that Dr. Altabtobai should be taken to court. This is a crime that should be punished by law; it’s against our constitution which has given women the freedom of choice.

I will also post about this subject as it makes my blood boil to have such a nonsensical fatwa issued.

It seems like this is "their" last card, to play against controlling Kuwaiti women.

We should not be that stupid to believe anything that Tabtabaei has to say. And yes, there should be an uproar at the implication of what he is saying.

Dear Ayya;
You think Prof. (LoooL!) Tabtebaaei (sp?) actually comprehends the concepts of civil laws or constitutions? He is a professor of Sharia, and that explains his atrocious opinions. And he is not alone, for who actually chooses to study Sharia? The answer is simple: those who are not competent enough to go to real schools, those who have no talents or who are simply too lazy to do anything meaningful would end up in ma3had deeni or kuleya’at al-sharia. Eventually, a number of those truants end up writing some laughably useless paper (ex: how to punish disobedient slaves according to Islamic traditions), and they end up with a degree in SHARIA :-D

Delicately Realistic, they haven’t ruined anything just yet. The issuance of this fatwa is going to be the beginning of the end for those who have absolutely no respect for women rights and the laws.

Also, I doubt this is what the late Amir HH Sheikh Jaber al-Ahmad al-Sabah (pbuh) had in mind when he promoted political rights for women. Prof Mohammed Al-Tabtebaei has absolutely no respect for his legacy. This fatwa is nothing less than a carte blanche to blackmail women as well as deny their constitutional, legal and human rights. Prof Mohammed Al-Tabtebaei should be prosecuted immediately to the fullest extent of the laws he is breaking.

Delicately Realistic
That’s what I felt when I read this.

Skunk, a3sab and DA
I do understand that Dr. Altabtobai had issued many ridiculous fatwas before, but this one is serious especially when it is brought up at this time. Not everybody is broad minded, and not all will think this is funny. And don’t forget the voting force of women. Men; especially religious ones might easily use this fatwa to their benefits. And this is deception. Women, on the other hand are more sentimental about religious issues, for some Altabtabai is a respected figure. So they could easily take the bate.
This issue is about 7alal and 7aram for some. Let’s assume that a woman wants to vote for “X” and her husband wanted her to vote for “Y” and he cunningly used the divorce issue, and don’t tell me that this won’t happen, some men kill each other in elections. She either obeys her husband and loose her right which I believe is more probable, or vote secretly and feel guilty all her life for sinning or even get a divorce in a worst scenario.
In any case; this has a very negative implication on the overall results.

Lady J
I think that you should do that, it is damn serious.

Ben
Thank you; I couldn’t have said it better

What you just said is exactly the other side of the coin; they want to distract people from the main issue: fighting corruption. They want us women to go seek shiyookhs and da3iyas and waste time discussing this fatwa issue. They want to create disturbances in each household. It smells really fishy.

Shame on you Tabtobai.
Why now? Because they're using religion (as always) for political gain. Not shocking at all..

But what kills me is that many people will actually follow this fatwa. because Allah said: " وأطيعوا الله وأطيعوا الرسول وأولى الأمر منكم"

يعني مسيو طبطبائي من أولي الأمر
استخفاف بعقول الناس جذي ما شفت
يبي يخرب بيوت الناس علشان حرية اختيار

tara it's not an official fatwa..he only made a suggestion to MAKE it a fatwa..it's not his right to issue fatwas without a council. if the council of scholars (3uluma'a) agree, then it's a fatwa.
I haven't seen/heard anything from anyone except him.

ma 3enda salfa yuba..after all..he enjoys mexico's beaches & their hot muchachas ;)

you can say that again.

You know Papi; some years back when I worked with WSCS on women’s political rights we used to have phone calls from women in tribal areas praising the movement. They complained with true sadness how they couldn’t join our movement because of their husbands. Some of these women were highly educated but seriously religious and believed in obeying their men as a sacred ritual. And I’m sure that this does not only apply to tribal women. What will happen to these women. Many women feel the sense of freedom to be able to give her voice to whom she believes in without the interference of her husband especially that the boll is secret.
Just the other day we were at a gathering with Dr. Badriyah AlAwadi as the main speaker, she mentioned this specific issue that she encountered with many women. Actually; it was some women who brought this subject up. For some it’s a vital issue. There was a sense of relief when Dr. Badriyah assured them of their rights religiously as well as politically, and that they have all rights to keep their votes secret. This gathering took place way before Al6ab6abai issues his Fatwa.

Mini Я.
It doesn’t matter dear, the fact that such utterance was from a person respected by many is enough to cause disturbance.

Zade
“this husband is WRONG and has committed a SIN by doing so. However, divorce does take effect because it only requires the word regardless of the condition”
Does this SIN PROHIBITS such a husband touching his wife? Ya3ni ma 6a7 inbi6a7!!!
WHY IN THE HELL HE HAS TO ISSUE SUCH A FATWA NOW? This is the question.
Almuhri; a Sheeat prominent religious figure even confirmed this fatwa more by saying that a woman can’t go out without the permission of her husband. So what if a man swears divorce to his wife if she left her house on the day of the election when her husband orders her to stay home?
And who is next?

Al6ab6ubai is creating a subject to distract people from fighting corruption. And this is my answer.

Ayya. Unfortunately. His technique is working and this is indeed distracting people from more serious political issues like intikhabat far3ia o shera ela9wat.

With that said. Tabtabaee seems to have been misquoted. Either that or he has retracted. Today we hear him saying that a husband has no right to order his wife regarding who she should or shouldn't vote for. But Alwatan on Thursday says:
وقال الطبطبائي لـ «الوطن» امس مجدداً ان الطلاق يقع في مثل هذه الحالة الافتراضية، ولكن لا يحق للزوج التدخل في اختيار الزوجة لمن تصوت له.
So he has no right to interfer, but if he did, divorce will be in action?

I don't understand politics. But I don't understand religion even more.

Mini R,

The man you refer to is Dr Waleed al-Tabtabae the former MP and chair of the human rights committee at the National Assembly.

His escapade in Mexico was well documented so it was rather ridiculous when he lied about it so forcefully (even threatened to sue).

But what else can a supreme hypocrite do?

Zade,

First, like your name.

Second, I think you ought to investigate for yourself that Tabtabae and the government are co-conspirators in this political snafu currently taking place in Kuwait.

I don't know if you are that naive, ignornant or corrupt but do wake up and smell the bullshit.

Zade,

You're right I don't know you and if you'd read carefully I wrote:

"I don't know if you are that naive, ignornant or corrupt but do wake up and smell the bullshit."

I didn't accuse you of anything; however, you did accuse me by stating: "just shows how morally and intellectually bankrupt you are."

You don't know me either.

If you had read any of the other pieces I've written over the years, you would have read evidence (from Kuwait's own ministries I might add) of my claims.

I always suggest that people who initially would disbelieve (as I once did) to obtain evidence on their own since that will make a believer out of them very quickly, if said individual really wants to know the truth of something.

Time will tell if you are truly as open-minded as you claim.

Listen; your guy had backed off in a very irresponsible and untrustworthy fashion. The fact that he did not send a letter complaining “his misquote” as you claim and demanding to publish his explanation at the same space in Alwatan only proves his collaboration with this filthy, pro government newspaper.
7abeebi, elmas2al wath7a wi ma yabeelha nabaha, he had accomplished his part and the damage is already done. I still think that he should be taken to court as well as Alwathan, so that not kil min hab wi dab yafti 3ala kaifah.

You thrilled and honored me with your presence, yet saddened me with AbaAl7akam’s poem. Am I the only one who misses him? Why do I find myself looking for him especially at this time? But you know what? I still haven’t lost hope that his sun would rise again, even if this was a mirage as some had told me.

Ayya,

Patience is something I learned in Kuwait and I've been patient for several years now. Waiting the bit longer that I'm forced to will be nothing especially since those corrupt individuals (Kuwaitis, Americans, et al) will face the justice each of them deserve; it will have been worth the wait.

Not to mention the other issues that are involved and will be resolved as a result.
